MNRE Approves Time-Extension for RE Projects Delayed by Supreme Court GIB Verdict

MNRE allows renewable energy projects in Rajasthan and Gujarat extra time due to delays in Section 68 approvals caused by Supreme Court GIB case pendency.

The Ministry of New and Renewable Energy (MNRE) has issued an order granting time-extension for renewable energy (RE) projects in Rajasthan and Gujarat affected by delays in Section 68 approvals for overhead power transmission lines. The delays arose due to the pendency of the Supreme Court case W.P.(C) 838/2019 concerning the Great Indian Bustard (GIB) areas.

According to the recent order, all implementing agencies, SECI, NTPC, NHPC, and SJVN, are directed to treat these delays as ‘Force Majeure’. Developers can seek extension of their Scheduled Commissioning Date (SCD) or Scheduled Commencement of Supply Date (SCSD) for the period between their Section 68 application (or 21 March 2024, whichever is later) and 19 December 2025, the date of the final Supreme Court judgement.

Extensions will also apply to intermediate project milestones, and developers can pass benefits down the value chain to EPC contractors, suppliers, and OEMs. Applications must be formally submitted to the relevant agency with supporting documents. Projects with SCD prior to 21 March 2024 or those that missed the application deadline before 19 December 2025 are ineligible.

The order ensures compliance with Supreme Court directions for projects overlapping GIB areas and aims to mitigate legal and regulatory delays for RE developers.
